Alexander Millman

Alexander has extensive experience in representing employers in throughout Australia in employment, industrial relations, and work health and safety matters both litigious and non-litigious.

Having acted for employers, employees, and industry bodies on both sides of the industrial divide, Alexander brings a unique perspective to assisting clients in addressing both discrete issues as they arise and broader strategic matters.

Alexander is known for his practical, risk-based approach and ability to advise clients in terms that are accessible, giving clear options and solutions without getting bogged down in legal jargon but which is nevertheless based on a deep understanding of the law.

Alexander’s practice covers clients in all industries, including educational institutions, not-for-profits, major retailers, construction and engineering firms, financial institutions and government agencies.

Expertise

Alexander’s expertise includes:

  • Prosecuting and defending employment claims in all relevant courts and tribunals
  • Advising on industrial relations strategy including in enterprise bargaining and responding to industrial action (both lawful and unlawful)
  • Managing interactions between clients and regulators in the work health and safety space
  • Advising in disciplinary matters at all levels of business
  • Conducting workplace investigations, including into sensitive matters such as harassment
  • Advising on underpayment matters, including the identification and quantification of underpayments and the managing regulatory responses

Recent Projects

  • Acting for a major construction company in the Federal Court of Australia to obtain an injunction restraining the unlawful conduct of a union during industrial action
  • Acting for a mining company in the Supreme Court of Queensland to obtain judicial review of the exercise of regulatory power by a work health and safety inspector during an investigation into a workplace fatality
  • Engaging with the health and safety regulator on behalf of a disability services provider to avoid prosecution in response to a workplace fatality
  • Acting for a private educational institution in the identification and quantification of underpayments and negotiating an enforceable undertaking with the Fair Work Ombudsman
  • Representing a multi-national engineering company in an executive contractual dispute with concurrent claims in Australia and South America
